Welcome to Euphony Therapy. These Terms of Service ("Terms") govern your access to and use of euphonytherapy.com (the "Site") and any related services, content, scheduling tools, or communications offered by Euphony Therapy ("Euphony Therapy," "we," "us," or "our"). By accessing or using the Site, or by booking or receiving services from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Who We Are

Euphony Therapy provides therapy and wellness services as described on the Site. These Terms apply to all visitors, clients, and users of the Site, whether browsing informational content, scheduling appointments, or communicating with us.

2. Eligibility

You must be at least 18 years old to use the Site or agree to these Terms on your own behalf. If you are scheduling services for a minor, you represent that you are the minor's parent or legal guardian and are authorized to consent on their behalf.

3. Services Offered

The Site provides information about our therapy and wellness services, and may allow you to request appointments, complete intake forms, or communicate with our practice. Nothing on the Site constitutes the provision of therapy, medical, or clinical services — actual services are provided only within the context of an established client relationship, subject to separate informed consent and intake documentation.

4. Not a Substitute for Emergency Care

The Site and any communications with us (including SMS, email, or contact forms) are not monitored continuously and are not appropriate for emergencies. If you are experiencing a medical or mental health emergency, or are in crisis, call 911 or go to your nearest emergency room. In the U.S., you may also reach the 988 Suicide & Crisis Lifeline by calling or texting 988.

5. Appointments, Cancellations, and Payment

• Appointments requested through the Site are subject to confirmation by our practice.
• Cancellation and rescheduling policies (including any applicable fees) will be communicated at the time of scheduling or intake and are incorporated into these Terms by reference.
• Payment terms, accepted insurance (if applicable), and billing policies will be disclosed separately during intake.

6. Communications (Email & SMS)

If you opt in to receive text messages from us, your use of that program is also governed by our SMS Privacy Policy. Standard message and data rates may apply. Email and SMS are not secure, encrypted channels — please avoid sending sensitive health information through these channels. We are not responsible for delays or failures in message delivery caused by your carrier or email provider.

7. User Conduct

When using the Site, you agree not to:

• Provide false or misleading information when scheduling or communicating with us
• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to our systems, accounts, or data
• Interfere with or disrupt the operation of the Site
• Copy, scrape, or reproduce Site content without our permission

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, and design — is owned by or licensed to Euphony Therapy and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent, except for personal, non-commercial use.

The Site may contain links to third-party websites or services (such as scheduling platforms or payment processors) that are not owned or controlled by Euphony Therapy. We are not responsible for the content, privacy practices, or terms of any third-party sites.

10. Privacy

Your use of the Site is also governed by our Privacy Policy and, where applicable, our SMS Privacy Policy, which describe how we collect, use, and protect your information. For clients receiving therapy services, our handling of protected health information is further governed by our HIPAA Notice of Privacy Practices, provided separately during intake.

11. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Information on the Site is provided for general informational purposes only and does not constitute clinical, medical, or professional advice. Use of the Site does not create a therapist-client relationship; that relationship is established only through a formal intake and engagement process.

12. Limitation of Liability

To the fullest extent permitted by law, Euphony Therapy and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Euphony Therapy, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles, unless otherwise required by applicable law.
